My Lords, after due consideration, we apply to concede to this appeal and consequently apply to withdraw the 1st respondent’s brief of argument dated May 17. We urge your lordships to find merit in the appeal and apply Article 14(b) and 15(2) of the PDP Electoral Guidelines which disqualifies any candidate that gives false age declaration.

The above recent admittance at the Supreme Court by the lawyer representing the PDP at the ongoing suit between Joe Agi SAN Vs PDP with Governor Ben Ayade as third respondent is troubling. It can define the tone and tenor of the 9 December judgment pending.
The Inter Party Advisory Committee (IPAC) in Cross River State is asking the National Judicial Council (NJC) to investigate the incident of the rejection of Mr Ben Ayade by his party, the Peoples Democratic Party (PDP).
A statement respectively signed by the Secretary and Chairman of IPAC Cross River, Paddy Ally and Baron Eyo, reads in part, 'IPAC frowns at the drama at the Supreme Court where a political party denies it's member, we say this attitude of the PDP as a party is uncultured, undemocratic and selfish.
'The action of the defense lawyer of a political party denying its client at the level it did is unethical, uncivilized and makes a ridicule of Nigeria's lawyers and its judicial process and progress. IPAC condemns this in totality and calls on the NJC to investigate the lawyer or lawyers to restore hope of Nigerians on lawyers', it continued.
